Terms of Service for Terrible Focus

1. Acceptance of Terms

By accessing or using Terrible Focus, you agree to these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Verena Ortlieb ("we," "us," or "our").

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal iOS device solely for your personal, non-commercial use.

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, redistribute, or sublicense the App
• Remove or alter any copyright, trademark, or other proprietary notices
• Use the App for any commercial purpose or in any way that violates any applicable law

3. Intellectual Property Rights

All rights, title, and interest in and to the App—including all graphics, artwork, characters (including the potato character), music, sound effects, text, code, and other content—are owned by us or our licensors. The App is protected by copyright, trademark, and other intellectual property laws.

"Terrible Focus" and the potato character are trademarks of Verena Ortlieb. You may not use these trademarks without our prior written permission.

4. In-App Purchases

4.1 Content Packs

The App may offer additional content packs for purchase ("IAP Content"). All purchases are processed through Apple's App Store and are subject to Apple's Terms of Service.

4.2 Payment

All purchases are final and non-refundable except as required by applicable law or Apple's refund policy. Prices for IAP Content are subject to change without notice.

4.3 Ownership

When you purchase IAP Content, you are purchasing a limited, non-transferable license to access that content within the App. You do not own the content itself.

5. User Conduct

You agree to use the App in a responsible manner. You will NOT:

• Use the App in any way that could damage, disable, or impair the App
• Attempt to gain unauthorized access to any systems or networks
• Use any automated systems or software to extract data from the App
• Interfere with other users' use and enjoyment of the App
• Use the App for any illegal or unauthorized purpose

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The App will meet your requirements or expectations
• The App will be uninterrupted, timely, secure, or error-free
• Any errors or defects will be corrected
• The App will be compatible with all devices or iOS versions

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of your device or data
• Any interruption or cessation of the App
• Any bugs, viruses, or other harmful code
• Any content or conduct of any third party
• Any loss of data, including game progress

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

8. Data Loss and Backup

While the App supports iCloud sync, we are not responsible for any loss of game progress or data. You are responsible for maintaining your own backups. We strongly recommend enabling iCloud sync to protect your progress.

9. App Updates and Changes

We may update, modify, or discontinue the App (or any part of it) at any time without notice. We are not obligated to provide updates, but if we do, these Terms will apply to updated versions unless accompanied by new terms.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, including if we believe you have violated these Terms. Upon termination, your license to use the App will immediately cease, and you must delete the App from all devices.

Sections 3, 6, 7, 8, and 12 will survive any termination of these Terms.

11. Third-Party Services

The App integrates with Apple services (iCloud, Push Notifications, In-App Purchases). Your use of these services is governed by Apple's Terms of Service and Privacy Policy.

We are not responsible for any third-party services or their content.

12. Children's Use

The App is intended for users of all ages. If you are under 18, you represent that you have your parent or guardian's permission to use the App. Parents and guardians are responsible for monitoring their children's use of the App.

13. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this document. Significant changes will be communicated through an in-app notification or update notes.

Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.
